I can't claim any specific expertise in the subject, but I find Jack Balkin's living originalism/framework originalism to be the most persuasive account of how to conceptualize constitutional practice.

Insofar as SCOTUS Justices are nominated by the President and confirmed by the Senate, some basic constitutional issues definitely are subject to democratic determination.
