I've had this discussion too many times, and I'm way to lazy to go digging out the book now, but anyway there's a book called Sour Gripes by Simon Carr about compensation culture and so on. I have no idea if it's accurate and unbiased, but anyway, in it the author alleges that there's an industry standard temperature for coffee and that's what temperature McDonald's were brewing it at, if you want to look into it.

Personally, I don't think a hot beverage being able to severely burn people means it's too hot. E.g. if I made tea, as I do several times a day, I'd make from boiling water, as just about anyone does. If I gave it to some who wanted no milk and then went for a drive with it between their legs (as that woman did) I don't see how I would be responsible for correctly making tea.
